Section 2 - Entre Droits US et Exportation

Il nous semble intéressant d'envisager l'approche américaine, d'une part parce que les Etats-Unis se sont dotés, très tôt, d'une législation dans ce domaine et que son approche en terme de droits d'auteurs est différente de la vision européenne et plus particulièrement française.135(*) De plus, l'exemple américain nous semble être le plus approprié dans la mesure où une grande partie des acteurs de la gestion des contenus en ligne proposant déjà des solutions ou ayant développés des techniques de DRM y sont établis ce qui nous permettra d'envisager à ce titre les transferts de flux de données vers ce pays et les implications que cela peut avoir en terme d'atteinte au respect de la vie privée.

§1 - Les Etats-Unis et le DMCA

On abordera ici l'attitude US vis-à-vis de ces difficultés liées à la maîtrise des Nouvelles Technologies. Les Etats-Unis se sont énormément impliqués dans cette problématique des droits d'auteurs. En effet, déjà en 1995, un White Paper136(*) recommandait que le Copyright Act soit amendé et que l'on y insère des dispositions interdisant le contournement des moyens techniques servant à protéger les oeuvres.137(*) Ainsi donc, à la suite du Traité OMPI de 1996, les américains vont se doter d'un outil de protection en adoptant le DMCA en 1998.

A cet égard, on se penchera évidemment sur les protections offertes par l'article 1201 du DMCA qui vise plus particulièrement les mesures techniques.138(*) Plus précisément, le DMCA sanctionne l'acte de contournement ainsi que les activités préparatoires. Trois infractions jusqu'alors inconnues en matière de copyright sont créées par le texte américain :

- le contournement de mesures techniques qui contrôlent l'accès aux oeuvres protégées par la loi ;

- la fabrication, la distribution et la diffusion de dispositifs ou la prestation de services visant à contourner les systèmes de contrôle d'accès ;139(*)

- la fabrication, la distribution et la diffusion de dispositifs ou la prestation de services permettant le contournement de mesures techniques de protection des droits des auteurs.140(*)

Ainsi, il semble que la problématique qui nous intéresse en Europe soit similaire aux Etats-Unis. En effet, cette législation qui étend la protection du copyright au-delà de l'oeuvre entraîne de facto une réduction des possibilités d'utilisation que chaque utilisateur peut en faire ce qui semblerait être contraire à la doctrine du fair use tel qu'elle a été voulu au départ.141(*)

L'usage équitable d'une oeuvre ne devenant de ce fait presque plus possible alors même que comme le dit Dan L. Burke « the use of intellectual property law is always a balancing act between allowing the greatest number of people to enjoy works at low cost, without lowering the cost so much that the works will never be created in the first instance. Indeed, this balance is constitutionally mandated in the United States, where the constitution provides Congress with the power to enact copyright laws only if such laws «promote the progress of science and the useful arts» ».142(*)

S'il est vrai que l'auteur doit évidemment conserver des droits sur ses oeuvres, cela ne doit pas forcément se faire au détriment exclusif de l'utilisateur en rompant ce fragile équilibre. C'est d'ailleurs bien ce que dit D.L. Burk lorsqu'il affirme que : « [t]he employment of the anti-circumvention statute to date should come as something of a surprise. The record suggests that the anticircumvention right was intended by Congress as a shield rather than a sword, intended as a means to prevent wholesale misappropriation of copyrighted content, rather than as a means to extend content owners' exclusivity to cover adjacent, uncopyrighted technologies. Yet the cases brought by rights holders thus far, have been characterized by a decided lack of anything resembling «piracy» or unauthorized copying ».143(*)

Similaire à la Directive IP Enforcement, du moins dans l'esprit, les Etats-Unis sont également en train d'étudier un projet de loi144(*) qui faciliterait les poursuites pénales contre le piratage. Le sénateur Leahy l'a intitulé « Protecting Intellectual Rights Against Theft and Expropriation Act of 2004 »145(*), et permetrait « [to] let the Justice Department file civil lawsuits against file swappers ».146(*) il prévoirait notamment un allègement de la charge de la preuve lorsqu'il indique « IN GENERAL- The Attorney General may commence a civil action in the appropriate United States district court against any person who engages in conduct constituting an offense under section 506. Upon proof of such conduct by a preponderance of the evidence, such person shall be subject to a civil penalty ».147(*)
