ABSTRACT
In order to strengthen the protection of the rights and
freedoms of citizens
and to preserve the national legal order, the
congolese constituent to think,
in the light of the renewal of african
constitutionalism, strengthen the work
of constitutional justice. The
referral by way of exception invoqued before
the administrative judge
participates favorably in this ideal.The ideal of a
congolese justice more
attentive and more respectful of the protection of
the rights and freedoms
of litigants. As evidenced by the remedies brought
by them to ensure that
their defence guaranteed by the supreme standard
prevails. Unfortunately,
reality still contrasts with the will of the original
constituent. The
reform having left a taste of unfinished, leaving the
passage of entire
sections of administrative litigation, however, necessary
to make the
exception of unconstutionality a useful work. Hense, the
interest of making
significant reforms.
