ABSTRACT
The seizure of assets placed in a safe deposit box belonging
to a third party under OHADA law is a complex procedure at the intersection of
several branches of law. Beyond being a mere container, the safe deposit box is
governed by a contract with significant implications for the liability of the
third-party holder. The assets whether tangible or intangible, fungible or
non-fungible require strict proof of ownership to validate the seizure, which
is regulated by the Uniform Act imposing the existence of an enforceable title
and strict procedural formalities. The enforcement judge plays a central role
in supervising the process, particularly during the opening of the safe deposit
box, the inventory of assets, and in handling disputes involving objections,
claims of ownership, and challenges to the seizure. This procedure illustrates
the balance sought between the effectiveness of debt recovery and the
protection of the rights of the creditor, the debtor, and the third party.
However, uncertainties remain regarding the scope of seizable assets, the legal
nature of the safe deposit box agreement, and the liability of the third party,
calling for legal developments aimed at enhancing transparency and harmonizing
case law.
